Playground equipment installation involves the assembly and fixing of climbing frames, swings, slides, shade structures and impact-attenuating surfacing at schools, parks, childcare centres and residential estates. The work combines earthworks for footings, concreting, powered mobile plant movement (excavators, skid-steers, mini-cranes and truck-mounted deliveries), work at height on modular structures, and manual handling of oversized prefabricated components. Sites are frequently constrained, adjacent to occupied buildings, and may expose workers to silica dust from cutting pavers or rebound rubber, buried services, and unstable excavations for footings.
Under the Work Health and Safety Regulation 2025 (NSW), section 291 defines high risk construction work (HRCW) and section 299 requires a Safe Work Method Statement to be prepared before that work commences. Playground installation typically triggers HRCW because of the movement of powered mobile plant on site, and often also work at height and near underground services. Controls must follow the hierarchy in section 36 β eliminate first, then substitute, isolate, engineer, administer, and lastly PPE β and be documented, consulted on, and reviewed under sections 47 and 302.

Control measures
Hierarchy-of-controls order: elimination β substitution β isolation β engineering β administrative β PPE.
- 1Eliminate on-site cutting where possible by ordering components pre-cut to length and factory-drilled; specify pre-cast concrete footings or ground anchors in lieu of wet pours where the design permits.
- 2Substitute petrol post-hole augers with hydraulic excavator-mounted augers to remove operator kickback risk, and substitute silica-based edging with pre-formed rubber edging where design allows.
- 3Isolate powered mobile plant from workers on foot using hard barricades, exclusion zones and a documented Traffic Management Plan compliant with AS 1742.3; use a dedicated spotter in direct radio contact with the operator during all lift and slew operations.
- 4Before any excavation, obtain Before You Dig Australia (Dial Before You Dig) plans, conduct non-destructive potholing (hydro-vacuum) within 500 mm of any indicated service, and comply with SafeWork NSW Code of Practice: Excavation Work.
- 5Engineer fall protection for assembly above 2 m using mobile scaffold or EWP compliant with AS/NZS 1576 and AS 2550.10; prohibit standing on partially-assembled play decks until edge protection or a fall-restraint anchor is installed.
- 6Shore, bench or batter any footing excavation deeper than 1.5 m per AS 5100 and the Excavation Work Code of Practice; keep spoil and plant at least 1 m clear of the excavation edge.
- 7Control silica dust using on-tool water suppression or H-class HEPA extraction on all grinders, saws and drills; comply with the workplace exposure standard of 0.05 mg/mΒ³ (8-hour TWA) and the SafeWork NSW Code of Practice: Managing the risks of respirable crystalline silica from engineered stone.
- 8Install full hoarding, mesh fencing (min 1.8 m) and lockable gates around the work zone in accordance with AS 4687; schedule high-risk work (crane lifts, excavation) outside school and childcare operating hours where practicable.
- 9Verify plant operators hold the correct High Risk Work Licence (CN, CV, LF etc.) under section 81 of the WHS Regulation 2025; conduct daily pre-start inspections and maintain plant per AS 2550 series.
- 10Provide task-specific PPE: safety helmets (AS/NZS 1801), Class H/D hi-vis (AS/NZS 4602.1), P2 respirators fit-tested per AS/NZS 1715 during cutting, cut-5 gloves, and eye protection to AS/NZS 1337.1; supply sunscreen, shade and rest breaks under a documented heat stress procedure.
- 11Implement administrative controls: daily pre-start toolbox talks, JSA verification against this SWMS, incident reporting, and supervision by a competent person with current construction induction training.
- 12All workers must hold the CPCCWHS1001 White Card, be inducted to this SWMS, and sign the consultation register in accordance with section 47 of the WHS Act 2011 (NSW); the SWMS must be reviewed under section 302 of the WHS Regulation 2025 whenever the work method, plant, personnel or site conditions change, or following any notifiable incident.

High-Risk Construction Work triggered
Excavators, skid-steer loaders, augers, telehandlers and delivery trucks manoeuvre within the work zone to excavate footings, place concrete, and lift prefabricated play modules into position, creating a struck-by and crush risk to workers on foot.
Section 299 of the WHS Regulation 2025 (NSW) makes it an offence for a person conducting a business or undertaking to direct or allow HRCW to commence without a compliant SWMS in place. Section 302 requires the SWMS to be reviewed and revised whenever controls are inadequate, work changes, or a notifiable incident occurs. A failure that exposes a worker to a risk of death or serious injury may be prosecuted as a Category 2 offence under section 32 of the WHS Act 2011 (NSW), or as a Category 1 offence under section 31 where the conduct is reckless. Current maximum penalties are set out in the SafeWork NSW penalty schedule as indexed from time to time.

Worked example
A fencing and landscaping contractor is engaged by a Sydney metropolitan council to install a new inclusive playground at a reserve in Marrickville. The scope includes a 4.2 m combination tower, in-ground swing bay, poured softfall, and a shade sail on 5 m masts. A 5-tonne excavator with auger attachment is used for footings, and a Franna-style pick-and-carry crane lifts the tower into place. Because powered mobile plant is moving within metres of workers on foot, section 291(o) is triggered and a SWMS is prepared and signed off before mobilisation. Dial Before You Dig plans are obtained; hydro-vacuum potholing identifies a live 240V feeder to a park lighting pole 600 mm off the swing bay footing, and the footing is relocated. Assembly above 2 m is completed from a scissor lift with harnesses in restraint. The reserve is fully hoarded during works, with the SWMS reviewed after a mid-project scope change to add a second shade sail.

Frequently asked questions
Is playground installation always high risk construction work in NSW?
It is HRCW whenever any of the section 291 categories are triggered. In practice, the movement of powered mobile plant (s291(o)) applies to almost every install, and work above 2 m (s291(b)) applies to towers, shade structures and roofed modules. A SWMS is therefore required under section 299 of the WHS Regulation 2025 (NSW) before work commences.
Do I need a High Risk Work Licence to operate the excavator or crane on the job?
Earthmoving equipment such as excavators and skid-steers do not require a national HRWL but do require documented competency and training. A pick-and-carry or slewing mobile crane requires the relevant CN, C2, C6 or CV licence under section 81 of the WHS Regulation 2025 (NSW). Riggers and dogmen require DG or RB/RI/RA licences as applicable.
How do we manage children and the public around a live playground build?
The site must be fully enclosed by hoarding or 1.8 m mesh fencing with lockable access gates, in line with AS 4687 and the Construction Work Code of Practice. Where the site is at a school or childcare centre, high-risk activities such as crane lifts and excavation are scheduled outside operating hours and coordinated with the site principal contractor through a written traffic and public safety plan.
When does this SWMS need to be reviewed?
Section 302 of the WHS Regulation 2025 (NSW) requires review whenever the control measures are not adequately controlling the risk, a change is proposed to the workplace or work method, new hazards arise, or a notifiable incident occurs. Consultation with workers under section 47 of the WHS Act 2011 (NSW) must occur at each review, and the amendment log within the document must be completed.
