Millwork installation involves the on-site fitting of manufactured joinery β€” reception counters, wall panelling, staircases, built-in cabinetry, feature ceilings and architectural trim β€” into commercial, retail and residential fit-outs. The work combines heavy, awkward assemblies with fine finishing tolerances, exposing carpenters to falls from stepladders, mobile scaffolds and elevating work platforms; crush and manual handling injuries from lifting sheet stock and pre-assembled units; lacerations from track saws, biscuit joiners and nail guns; and respirable dust from cutting engineered wood products, MDF and stone-composite benchtops.

Where any component of the installation involves a risk of a person falling more than 2 metres, the work is high risk construction work under section 291 of the Work Health and Safety Regulation 2025 (NSW), and a Safe Work Method Statement must be prepared before work commences under section 299. Controls are applied in accordance with the hierarchy in section 36, prioritising elimination and engineered fall protection over administrative measures and PPE.

Control measures

Hierarchy-of-controls order: elimination β†’ substitution β†’ isolation β†’ engineering β†’ administrative β†’ PPE.

  1. 1Eliminate at-height cutting by pre-machining and pre-finishing millwork off-site in the joinery shop wherever practicable, delivering components ready to fix
  2. 2Substitute engineered stone with lower-hazard bench materials (timber, laminate, porcelain slab) where design permits; where stone is retained, all cutting must comply with the SafeWork NSW Code of Practice: Managing the risks of respirable crystalline silica from engineered stone
  3. 3Provide compliant edge protection, mobile scaffolds to AS/NZS 1576 or elevating work platforms operated in accordance with AS 2550.10 for any installation where a fall of more than 2 m is possible; ladders used only for light, short-duration access per the Code of Practice: Managing the risk of falls at workplaces
  4. 4Isolate and verify de-energisation of circuits in the fixing zone; use a cable and stud detector before every penetration and obtain a services drawing or dial-before-you-dig equivalent for in-slab and in-wall services
  5. 5Use tools with on-tool dust extraction (M or H-class vacuum to AS/NZS 60335.2.69) for all cutting, routing and sanding of wood-based panels and stone; wet-cutting for engineered stone with slurry containment
  6. 6Sequence heavy lifts using two-person carries, panel lifters, stair-climbing trolleys or mechanical hoists; secure tall freestanding units to studs or bracing immediately upon positioning and before release
  7. 7Set nail guns to sequential-actuation trigger mode for all trim work in accordance with AS/NZS 60745; keep the non-firing hand outside the exclusion zone and never disable the safety contact
  8. 8Where refurbishment work is undertaken in a structure constructed before 31 December 2003, obtain and review the asbestos register under section 422 of the WHS Regulation 2025 (NSW) before any penetration, cutting or removal of linings
  9. 9Enforce PPE: P2 respirator (P3 or PAPR for engineered stone), Class 5 eye protection to AS/NZS 1337.1, Class 5 hearing protection to AS/NZS 1270, cut-resistant gloves and safety footwear to AS/NZS 2210.3
  10. 10Maintain housekeeping β€” offcuts, packaging and cords cleared every break; designate a cutting station away from active fixing areas and other trades
  11. 11Health monitoring for workers with ongoing silica or wood-dust exposure in accordance with sections 368–378 of the WHS Regulation 2025 (NSW)
  12. 12All workers hold CPCCWHS1001 (White Card); the SWMS is developed in consultation with workers under section 47 of the WHS Act 2011 (NSW), signed on before work starts, and reviewed under section 302 whenever controls, personnel or the work environment change

Legal consequence

Section 299 of the WHS Regulation 2025 (NSW) requires a SWMS to be prepared before the high risk construction work commences, and section 302 requires review of the SWMS if controls are inadequate or circumstances change. Failure to comply exposes the PCBU and officers to Category 1 offences (reckless conduct) under section 31 of the WHS Act 2011 (NSW) and Category 2 offences under section 32; current maximum penalties are published in the SafeWork NSW penalty schedule.

Worked example

A shopfitting contractor is engaged to install a 3.4 m high veneered feature wall, reception counter and integrated joinery in a professional services tenancy on George Street, Parramatta. Because fixing the upper panels and cornice requires work more than 2 m above the finished floor, the work is high risk construction work under section 291. Before mobilising, the contractor prepares this SWMS, isolates the ceiling void lighting circuit, hires a compliant mobile scaffold to AS/NZS 1576.1 for the panel fix, and pre-machines the reception stone top off-site to eliminate on-site engineered-stone cutting. All three installers hold White Cards and EWP/scaffold tickets appropriate to the equipment used. The SWMS is signed on at the site induction, kept at the tenancy for the duration of the works, and reviewed on day three when the program is compressed and a second crew is added.

Frequently asked questions

Do I still need a SWMS if only the top row of shelving is above 2 m?

Yes. Section 291 is triggered by the risk of a fall greater than 2 metres, not the duration or extent of the task. If any part of the installation exposes a worker to that fall risk, the entire scope of work is high risk construction work and a SWMS is required under section 299 before that work commences.

Does this SWMS cover engineered stone benchtop cutting?

It covers incidental scribing and fitting of pre-cut engineered stone with wet-cutting and on-tool extraction controls. Any substantive on-site processing of engineered stone requires additional controls consistent with the SafeWork NSW engineered stone code, and workers must be on a silica health monitoring program under sections 368–378 of the WHS Regulation 2025 (NSW).

Can I use a platform ladder instead of a mobile scaffold for high-level fix?

Only for light, short-duration tasks where a risk assessment demonstrates a ladder is the most appropriate control per the Code of Practice: Managing the risk of falls at workplaces. Two-handed panel handling, extended reaching or working with power tools at height should be performed from a mobile scaffold to AS/NZS 1576.1 or an EWP operated in line with AS 2550.10.

Who has to sign the SWMS?

Every worker who will perform the high risk construction work must sign on before starting, confirming they have been consulted on the content and understand the controls. The SWMS must be developed in consultation with those workers under section 47 of the WHS Act 2011 (NSW) and made available for inspection under section 300 of the WHS Regulation 2025 (NSW).
