Frequently asked questions

Is post-construction builders clean classified as high-risk construction work requiring a SWMS?

Yes, in most cases. Under WHS Regulation 2025 clause 291, a SWMS is mandatory where cleaning involves any of the 18 high-risk construction work (HRCW) categories — most commonly work at heights over 2m, exposure to silica dust, asbestos disturbance, energised electrical installations, or use of hazardous chemicals. A standard builders clean on a multi-storey site almost always triggers two or more HRCW categories, so a SWMS must be prepared, signed and held on site before work starts.

What is the difference between a SWMS and a JSA for cleaning contractors?

A SWMS is a legal document required under WHS Regulation 2025 specifically for high-risk construction work, and must identify hazards, assess risks, list controls and describe how controls will be implemented, monitored and reviewed. A JSA (Job Safety Analysis) is a broader risk-assessment tool with no specific regulatory format. For construction cleaning falling under HRCW — blasting, heights, hazardous chemicals — a SWMS is mandatory; a JSA alone does not satisfy the principal contractor's duty.

Do I need a separate SWMS for hydroblasting above 15,000 psi versus standard pressure washing?

Yes. Ultra-high-pressure hydroblasting above 10,000 psi presents kickback, struck-by, and immersion-injection injuries that ordinary pressure washing does not. AS 4233.1 (High-pressure water jetting systems) and industry guidance require specific operator competency, dump-gun controls, exclusion zones and dedicated PPE. The SWMS must address these explicitly — including emergency response for injection injury — which is why a separate, task-specific SWMS is required rather than a generic cleaning document.

Are trauma and biohazard cleaning covered by construction SWMS or a different framework?

Trauma, crime-scene and biohazard cleaning fall under the WHS Regulation 2025 duties for managing biological hazards and hazardous chemicals, plus state public health legislation governing clinical and infectious waste transport. The SWMS must address bloodborne pathogen exposure, sharps handling per AS/NZS 3825, RPE per AS/NZS 1715/1716, chemical disinfectant SDS controls, and psychosocial risk to workers. It is not a construction SWMS per se, but follows the same SWMS structure and signature requirements.

Do SWMS for construction cleaning need to be state-specific across NSW, VIC, QLD and WA?

The SWMS content itself is largely harmonised because all jurisdictions except Victoria adopt the model WHS Regulation 2025. Victoria operates under OHS Regulations 2017 but recognises equivalent SWMS content. Western Australia adopted the model laws in 2022. Practically, a well-written national SWMS that cites the model WHS Regulation, relevant CoPs and AS/NZS standards will be accepted by principal contractors in all states, provided site-specific hazards and the responsible PCBU are documented before work begins.
