Category 2 offences (failure to comply with a health and safety duty that exposes a person to a risk of death or serious injury) carry a maximum penalty of $1,500,000 for a body corporate and $300,000 and/or 5 years imprisonment for an individual. From 1 July 2026, Section 26A of the WHS Act further requires that PCBUs comply with all applicable Codes of Practice โ€” this SWMS already cites the relevant Codes.
