Is trench work over 1.5 metres deep classified as high-risk construction work in Australia?
Yes. WHS Regulation 2025, Schedule 1 explicitly classifies work in or near a trench or shaft deeper than 1.5 m as high-risk construction work (HRCW), triggering a mandatory SWMS before work starts. The Model Code of Practice: Excavation Work further requires a competent person to assess ground conditions and specify shoring, benching or battering. SWMS must be prepared, signed by workers, kept on site and reviewed if conditions change or a control fails.
Do I need to call Before You Dig Australia (DBYD) before every excavation?
Yes — DBYD referral is the regulator-expected starting point for any ground disturbance, including hand digging. DBYD plans are indicative only, so the Model Code of Practice: Excavation Work and AS 5488 (Classification of Subsurface Utility Information) require physical verification through potholing, electromagnetic locating or vacuum excavation before mechanical digging near plotted services. What is the difference between a SWMS and a JSA for plumbing and excavation work?
A SWMS is a legally required document under WHS Regulation 2025 for the 18 categories of high-risk construction work listed in Schedule 1, including trenching over 1.5 m and work near energised services. A JSA (Job Safety Analysis) is a general planning tool with no specific legal status. SWMS must identify the HRCW, hazards, control measures using the hierarchy of control, and how controls are implemented, monitored and reviewed. For civil plumbing, a SWMS is mandatory — a JSA alone will not satisfy a regulator inspection.
Are sewer pump stations and wet wells considered confined spaces under Australian WHS law?
Yes. Sewer pump stations, wet wells and manholes meet the AS 2865 and WHS Regulation 2025 definition of a confined space — they are enclosed or partially enclosed, not designed for continuous human occupancy, and have a risk of harmful atmosphere, engulfment or oxygen deficiency. Entry requires a confined space entry permit, atmospheric testing, mechanical ventilation, a trained standby person, rescue equipment and workers holding a confined space entry unit of competency. Do civil plumbing SWMS need to be customised for each state or territory?
The model WHS Regulation 2025 framework is harmonised across most Australian jurisdictions, so the core SWMS structure is consistent. However, plumbing licensing, dial-before-you-dig service names, recycled water rules and notifiable excavation thresholds vary — for example Victoria operates under OHS Regulations 2017 rather than the model WHS Act. Our templates are state-neutral in structure but include prompts to insert jurisdiction-specific regulator references, plumbing licence numbers, and local water authority approvals before issue to the site.
