Is confined space work classified as high-risk construction work in Australia?
Yes. Confined space work is Category 11 high-risk construction work under Schedule 3 of the WHS Regulation 2025. This means a written SWMS must be prepared and in place before work begins on any construction project, in consultation with workers performing the entry. The SWMS must identify confined space hazards, specify control measures aligned with AS 2865:2009, and detail emergency response. Inspectors routinely request SWMS, entry permits, and atmospheric test records together during compliance audits.
Do I need a separate SWMS for confined space rescue and the stand-by team?
Yes — best practice and Regulation 74 of the WHS Regulation 2025 require documented emergency procedures specific to the rescue method. Where a dedicated stand-by rescue team is deployed (common for vertical entries, IDLH atmospheres, or breathing apparatus work), a separate Confined Space Rescue SWMS captures retrieval rigging, BA duration calculations, communication protocols, and casualty handling. Combining entry and rescue into one document often leaves rescue controls under-specified, which is a frequent inspector finding.
What's the difference between an entry permit and a confined space SWMS?
A SWMS is the overarching risk-control document required under Regulation 299 — it describes the hazards, controls, training, and PPE for the activity. An entry permit, required under Regulation 67, is the site-specific, time-limited authorisation issued for each individual entry, capturing live atmospheric readings, isolations confirmed, and personnel on register. You need both. The SWMS sets the system; the permit operationalises it for that shift and that space.
Does atmospheric testing need to be continuous or just pre-entry?
Both. AS 2865:2009 and the Confined Spaces Code of Practice require pre-entry testing of oxygen, flammable gases, and likely contaminants, followed by continuous monitoring throughout occupancy where conditions may change — which is most real-world entries. Gas monitors must be bump-tested before each use and calibrated per manufacturer schedule. The SWMS should record the test sequence, action levels for evacuation, and who holds competency to interpret readings.
Are state-specific confined space SWMS required, or is one national template sufficient?
The model WHS Regulation 2025 is harmonised across most jurisdictions, so a single SWMS structure is generally accepted in NSW, QLD, ACT, NT, SA, TAS, and Commonwealth workplaces. Victoria operates under the OHS Regulations 2017 and WA under the WHS Regulations 2022 — both with substantively similar confined space duties but different clause numbering.
